Welcome to Pulse. Pulse Radio Pty Ltd is a platform for electronic and popular music. Via our platform we bring together Event Promoters, fans and artists and labels to discover, share and experience a music culture. Our platform and web pages enables Event Promoters to list events, create tickets, sell inventory, market, promote and manage their events.
Pulse Radio publishes content on its website so that you, the “fan” or user, may explore to transact and interact with the event promoter. Pulse Radio is consistently evolving the way people discover, generate, interact, promote and experience electronic music.
Pulse Radio connects artists, fans and Event Promoters and is at the heart of electronic music.
You must be 18 years or older to use the Pulse radio ticketing platform.
By visiting or using the Pulse Radio ticketing platform, you expressly agree to be bound by these terms and conditions and to follow these terms and conditions and all applicable laws and regulations governing the Pulse Radio ticketing platform.
Pulse Radio Pty Ltd and pulseradio.net collectively (“Pulse Radio”), reserves the right to change the terms and conditions at any time effectively immediately upon posting on the Pulse Radio platform. To ensure you are aware of the latest terms and conditions please check these terms and conditions periodically. The latest date of issue will be posted on the top of this page.
You may only submit content to the Pulse Radio website and ticketing platform where you have the rights to do so. In particular the following activities are prohibited:
(i) Use of the Pulse Radio website to unlawfully transmit copyrighted material (including articles, images, stories and software) without a license, express consent, valid defence or fair use exemption to do so.
(ii) Uploading content that infringes the copyright or other intellectual property rights of Third Parties (such as privacy or publicity rights).
TERMS AND CONDITIONS
1. Event Promoters
There are two ways Event Promoters can use the Pulse Radio website and ticketing platform to sell tickets. An Event Promoter may choose to endorse Pulse Radio as the authorized seller of tickets to an event (“endorsed event”) alternatively an Event Promoter may choose use the Pulse Radio website as a platform to promote and market their events and thereby retain the rights and obligations to be the authorized seller of tickets to the event (“retained event”).
Pulse radio is in no way responsible for the content of the events uploaded onto its platform and this falls solely within the responsibility of the Event Promoter.
The Event Promoter is responsible for ensuring the details regarding the listed events are correct and including, but not limited to the following:
(i) The Event Promoter is responsible for ensuring entry times, ticket prices, door policy or all other venue requirements are correctly set out for the event.
(ii) The Event Promoter is responsible for securing the attendance of artists promoted to be performing at the event.
Occasionally, events are cancelled or postponed by the Event Promoter due to weather conditions or situations affecting the staff, artists or audience. When this occurs the Event Promoter will make every effort to facilitate a prompt refund and/or exchange if applicable as follows:
(i) Notify the ticket purchaser (“user”) by email if their email address is known.
(ii) Post notices on the Event Promoter’s website for contact regarding refunds via an email supplied by the Event Promoter.
(iii) Refund to the credit card used to purchase the ticket or provided by the user within 14 days of cancellation of an event by the Event Promoter.
Pulse Radio and the Event Promoter will agree to a booking fee to be paid to Pulse Radio at the point of sale of a ticket for both endorsed events and retained events.
The Event Promoter agrees that the booking fee will be either included in the advertised price of the ticket or charged as a separate item but disclosed as such on the event listing information published on the Pulse Radio ticketing platform prior to the point of sale.
The Event Promoter agrees to use a payment processing gateway nominated by Pulse Radio for the processing of ticketing transactions for any event on the Pulse Radio ticketing platform and understands that Pulse Radio will deduct its booking fee at the point of sale.
Should the event promoter cancel an event, Pulse Radio will not refund to the Event Promoter the booking fee that has been received by Pulse Radio.
Pulse Radio accepts no responsibility for misused event promoter accounts.
Pulse Radio is not liable for losses incurred due to the misuse of accounts by the account owner or another party. This includes, but is not limited to, incorrect withdrawal of funds, incorrect event information and other general misuse of the account.
From time to time an event promoter for an endorsed event may apply for the release of some of the funds from ticket sales held in the merchant account of Pulse Radio to secure artists and pay for associated costs in staging and event. Pulse Radio, may, in good faith and at its own discretion, release some monies held in its account to the event promoter to cover such expenses. Otherwise all money from ticket sales held in the Pulse Radio merchant account will be paid to the event promoter within fourteen (14) days of the staging of an event.
Pulse Radio provides a platform to reps to enable to provide tickets for events in return for a Commission.

The responsibility for setting the commission terms is solely between the Event Promoter and the rep.
Reps are neither employed by the Event Promoter or Pulse Radio directly. It is the reps sole responsibility to declare any income obtained from commissions and are responsible for their own tax liabilities.
Pulse Radio is acting purely as a platform to reps to earn commission.
Reps are responsible for informing Pulse Radio of any bugs or issues with the platform. Pulse Radio is in no way liable for losses caused by these bugs or issues but will endeavor to fix these as soon as possible.
3. Ticket Buyers
By using the Pulse Radio platform you, as a ticket buyer, acknowledge that you have read these terms and conditions and the difference between an endorsed event where Pulse Radio is the authorized seller of the tickets and a retained event where the event promoter remains the authorized seller of the event.
In particular as the ticket buyer you acknowledge that for retained events it is the sole responsibility of the event promoter to comply with its obligations as the authorized seller for the event including retaining the funds from the sale of tickets in its own merchant account and any refund that may become payable is the responsibility of the event promoter. The ticket buyer is to refer to the terms and conditions contained on the event promoter’s website.
As a ticket buyer using the Pulse Radio platform you acknowledge that Pulse Radio will charge a booking fee for any event listed on the Pulse Radio website or ticketing platform in addition to the costs of a ticket to an event. This booking fee will be either included by agreement with the Event Promoter in the ticket price or be charged in addition to the ticket price but disclosed to you on the event page.
In either circumstance you acknowledge that this fee will be paid to Pulse Radio at the point of sale of a ticket to an event and is not refundable by Pulse Radio in any circumstances including cancellation of an event.
You must be aware that in some territories government regulations require proof of identity of age at licensed venues and you may need to present this proof at the event venue to obtain admission. Pulse Radio recommends that you carry a valid driver’s license, passport or proof of age document to any event at a licensed venue.
INDEMNITIES AND EXCLUSIONS
All users, ticket buyers and Event Promoters undertake to fully indemnify Pulse Radio against all actions, suits or claims arising out of any illegal use by them of the Pulse Radio platform including the legal costs and disbursements of such proceedings.
Pulse Radio shall not be responsible for any delay in, or failure of, the Pulse Radio website or its ticketing platform due to any occurrence commonly known as force majeure or matters out of the control of Pulse Radio including war, riots, embargoes, terrorism strikes etc. which prevent or hinder the performance of the Pulse Radio ticketing platform.
The rights and obligations as set out in these terms and conditions shall be governed and construed in accordance with the law of New South Wales, Australia and all users and Event Promoters submit themselves to the exclusive jurisdiction of the Supreme Court of New South Wales in respect to any claim (including non-contractual disputes or claims).
